Zusammenfassung
Im September 2007 veröffentlichte die Europäische Kommission ihre Vorstellungen zu einem dritten Richtlinienpaket für die europäischen Energiemärkte. Der im Moment wichtigste und heiß diskutierte Aspekt betrifft sicherlich die Vorstellungen zu einer weiter reichenden vertikalen Entflechtung der Übertragungsnetze im Strombereich bzw. der Fernleitungsnetze im Gasbereich. Der Hintergrund ist die Unzufriedenheit der Europäischen Kommission mit den Entwicklungen des Wettbewerbs in vielen europäischen Energiemärkten einerseits und die zu langsame Entwicklung hin zu einem europäischen Energiebinnenmarkt andererseits, was sich auch in erheblichen Engpässen an den grenzüberschreitenden Netzverbindungen, den Interkonnektoren, widerspiegelt. In beiden Fällen erwartet die Kommission eine Verbesserung bzw. Beschleunigung der Entwicklungen durch eine weiter gehende vertikale Entflechtung von Netz und Betrieb. Die Netze sind nach wie vor monopolistisch, und es ist, von kleinen Ausnahmebereichen abgesehen, auch nicht damit zu rechnen, dass ein effektiver Wettbewerb bei den Netzen Fuß fassen könnte. Die Liberalisierungsbemühungen zielen auf die eigentlichen Wettbewerbsbereiche wie Erzeugung, Verkauf und Handel. Ein funktionsfähiger Wettbewerb in diesen Bereichen setzt den diskriminierungsfreien Zugang zu den monopolistischen Netzen voraus. Wettbewerbspolitisch und ordnungspolitisch besteht jedoch das Problem, dass ein vertikal integriertes Unternehmen im Prinzip die Möglichkeit hat, durch die Marktmacht im Netz Konkurrenten im Wettbewerbsbereich zu benachteiligen. Genau hier setzt die politische und ökonomische Debatte um das Unbundling an.
