Zusammenfassung
Vergleichende Werbung wurde aufgrund rechtlicher Restriktionen in der EU und in Deutschland lange Jahre nur beschränkt eingesetzt, in den USA hingegen ist es eine beliebte Werbeform. Vergleichende Werbung wird dort selbst in aggressiver Form nahezu unbegrenzt zugelassen (vgl. Zhang/Kardes/Cronley, 2002, S. 303). Beispiele sind die dort vorherrschenden vergleichenden Werbeschlachten von McDonald’s gegen Burger King oder Coca-Cola gegen Pepsi. In Deutschland war vergleichende Werbung lange Zeit nur in bestimmten Ausnahmen erlaubt. Hierzu zählte der Abwehr-, Auskunfts-, Fortschritts-, Aufklärungs- und Systemvergleich (vgl. Rudlowski, 1993). Im Oktober des Jahres 1997 wurde jedoch eine EU-Richtlinie zur vergleichenden Werbung verabschiedet, die in den Mitgliedsstaaten innerhalb von zweieinhalb Jahren in nationales Recht Eingang finden musste. Diese Richtlinie geht von einer prinzipiellen Zulässigkeit vergleichender Werbung aus, die aber strikt mit zwingend einzuhaltenden Voraussetzungen verbunden ist (vgl. Rennhak/Kapfelsberger, 2000, S. 1). Die Umsetzung der EU-Richtlinie 97/55/EG wurde vom Bundesgerichtshof (BGH) bereits im Jahre 1998 aufgegriffen. Der BGH stütze sich in verschiedenen Urteilen im Jahr 1998 auf die EU-Richtlinie und distanzierte sich von der bisherigen Rechtssprechung, dass vergleichende Werbung gemäß des Gesetzes gegen den unlauteren Wettbewerb (UWG) als Wettbewerbs- und sittenwidrig gelte (vgl. Menke, 1998, S. 811f.; Varlam, 2000). Der Bundestag hat im Juni 2000 die Anpassung des UWG an die EU Richtlinie 97/55/EG verabschiedet und somit den Einsatz für vergleichende Werbung in Deutschland geebnet (vgl. Rennhak/Schwaiger, 2004, S. 591).
