Zusammenfassung

Moderne politische Ordnungen sind Repräsentationssysteme. Das gilt auch und gerade für demokratische Systeme. Die Dichotomie zwischen direkter und repräsentativer Demokratie taugt daher nicht (mehr) als Ausgangspunkt zur Beschreibung demokratischer Systeme; sie ist zu einer Frage der Binnendifferenzierung geworden, die darüber Auskunft gibt, in welchem Ausmaß direkte, unmittelbare oder plebiszitäre Elemente vorhanden und geeignet sind, mit den Repräsentationsstrukturen zu konkurrieren. Die Funktionalität eines spezifischen Sets an Institutionen kann jedoch nur zur Begründung der Notwendigkeit dienen, nicht zu deren Rechtfertigung in einem normativ gehaltvollen Sinne.
