Zusammenfassung
Anfang März 2017 stellten neun syrische Geflüchtete beim Generalbundesanwalt (GBA) Strafanzeige wegen in Syrien begangener Kriegsverbrechen und wegen Verbrechen gegen die Menschlichkeit, um mit Hilfe des Weltrechtsprinzips internationale Haftbefehle gegen Mitarbeitende des Assad-Regimes zu erwirken. Somit ist Deutschland aktuell eines der wenigen Länder weltweit, an dem strafrechtliche Aufarbeitung für die vom Assad-Regime begangenen Verbrechen angestrebt wird. Doch finden diese Verfahren fernab vom Aufenthaltsort der meisten von der Gewalt betroffenen Personen statt, was deren Beitrag zur Transitional Justice für Syrien erschwert. Dieser Artikel ordnet die Verfahren auf Basis des Weltrechtsprinzips für in Syrien begangene Verbrechen in den weiteren Kontext von Transitional Justice ein, um die sie anschließend ausführlicher zu beschreiben, da es sich hierbei um ein neues und bisher kaum erforschtes Phänomen handelt.
Abstract
In early March 2017, nine Syrian refugees filed a complaint reporting war crimes and crimes against humanity perpetrated in Syria with the Federal Prosecutor General of Germany. Their aim was to obtain international arrest warrants for members of the Assad regime via the principle of universal jurisdiction. This currently makes Germany one of the few countries in the world in which the criminal prosecution of crimes committed by the Assad regime is being attempted. However, these legal proceedings are taking place far from most of the people affected by or involved in the violence, which hampers the proceedings’ contribution to transitional justice for Syria. This article situates the criminal proceedings on the basis of universal jurisdiction for crimes committed in Syria within the broader context of transitional justice before describing them in more detail, as they constitute a new and little researched phenomenon.

Prozesse gegen Mitglieder nichtstaatlicher bewaffneter Gruppen werden indes in einigen Ländern geführt und haben in Deutschland bereits zu Verurteilungen geführt (Safferling und Petrossian 2019, S. 405).
Hinzu kommen zwei ähnliche Fälle, in denen die Angeklagten jedoch deutsche Staatsangehörige sind.
