Introduction

National courts can play a key role in the advancement of the right to food by ensuring that the right is upheld and through providing redress to individuals whose rights have been violated. However, while the right to food has been enshrined in international law since 1948, it is only over the past twenty years that the international community has sought to clarify the content and scope of the right and that states have begun to adopt the right into domestic legal systems. Right to food litigation is still in a nascent stage of development, with a growing but still limited number of domestic courts around the globe having expounded upon its tenets or made findings of violations. Nevertheless, there have been cases where litigants have claimed violations of the right to food and where courts have made significant rulings....
