Definitions

Discrimination is difficult to define, but there is a common agreement that it occurs when comparable situations are treated differently and different situations treated in the same way (Maliszewska-Nienartowicz 2014). Generally, discrimination involves treating a person with a particular characteristic less favorable than others because of feelings of dislike or hostility toward persons with their characteristics (Bracken 2017; Adami v Malta 2006; McCrudden 1991). Although this definition adapts to a general definition of discrimination, it suggests that discrimination is motivated by prejudice. However, discrimination from an international law perspective is understood as unfair treatment to persons because of sex, race, age, nationality, religion, ethnicity, or political affiliation (Rourke and Swaine 2018; Aiyar 1997; article 14 of European Convention on Human Rights, 1950).
