Abstract

This comparative analysis of the dispute settlement mechanisms (DSMs) of the North American Free Trade Agreement (NAFTA) and certain European Union (EU) international agreements will focus exclusively on the so-called general trade dispute settlement procedures in these contractual instruments. The particular rules applying to direct foreign investment-related dispute settlements, which should take pride of place in the EU’s future agreements with partners in various industrialized and emerging economies, will not be included within the remit of this study.
