Abstract
The contentious politics of tobacco control, and the global reach of tobacco companies, are leading to increasing numbers of trade and investment disputes centered on tobacco. What can be done to prevent existing and future tobacco control regulations from being challenged through these disputes? How can tobacco control policies be made more ‘trade-proof’? Jarman examines common challenges to tobacco control policies caused by trade and investment disputes, and proposes potential solutions to each. Jarman argues that will of politicians to pursue and uphold tobacco control regulations is strongly shaped by the scope of these political conflicts, in other words, by which actors are able to have their views represented in the trading system.
