Abstract
The author presents an overview of the way in which capital punishment policy has been run within Japan’s tightly knit institutional framework and investigates the government’s approach to this policy. After reviewing the current academic approach to Japan’s retention of capital punishment, an analytical framework for understanding death penalty policy in Japan is presented. By unpacking governmental actors surrounding this system, the chapter identifies who exactly is involved in running this policy, and on what legal grounds the death penalty has been justified.
