Abstract
David Hallowes’ chapter provides a critical analysis of South Africa’s post-apartheid constitutional order with a focus on its Bill of Rights and the implications of the latter for environmental justice and rights. The chapter shows the contradictions that characterize the country’s democratic constitution order and its limits as a resource for struggles for environment rights and justice.
