Summary

In 1996, the proposal for a Council Directive on strategic environmental assessment was finally adopted by the EU Commission.1 The SEA Directive extends the principles of EIA to plans and programmes (regional planning, land use planning) as far as these replace decisions on the project level. The basis for the assessment forms an environmental statement which has to contain information about environmental quality objectives established at international, Community or Member State level which are of relevance for the respective plan or programme has to be outlined. Furthermore, the way these objectives and any other environmental considerations have been taken into account during the preparation of the plan or programme. In cases where the implementation of a plan or programme is likely to have significant effects on the environment in another Member State, the authorities of the other state have to be informed and consulted. In order to avoid disparities in the evaluation of environmental significance in border regions, it is recommended to co-ordinate national environmental quality objectives in border regions and to develop strategies to ensure that the objectives are met in those cases where national environmental standards differ.

  14. In the Netherlands, planning restrictions are used within the 35–40 cost unit zone. Houses which are situated within the 40–55 cost unit zone get noise protection measures (e.g. windows). Owners of houses in the 55–65 cost unit zone have the choice either to abandon their houses against compensation or to accept noise protection measures for their houses. In Germany, houses can only be built in noise protection zone I and II if the requirements of the Fluglärmgesetz (Airport Noise Act), section 6, are met. Residents within noise protection zone I are entitled to monetary compensation for soundproofed windows.
