Abstract

Judicial application of law is here analysed within the framework of a descriptive and normative theoretical approach. This involves a more simplified approach than would be involved in description. This is because the present approach inter alia is treated as a “modelling” or “idealising” of the object it accounts for, i.e., the judicial application of law, either as it exists or as it may be postulated for the purposes of theory.
