Résumé

L’arbitrage est en Hongrie d’une ancienne tradition. Il est établi que l’on s’en est remis à l’arbitrage dès le XII—XIVe siècle, à raison des difficultés de la procédure médiévale. Cependant, l’arbitrage au sens actuel commence seulement au XIXe siècle. Les articles 495–511 de la Loi No. LIV de 1868, modifiés en 1881, furent les premiers à donner une réglementation détaillée de l’arbitrage. Le système adopté par cette loi apparut comme loin d’être pratique, du fait par exemple qu’il requérait un tribunal arbitral de cinq membres. Ainsi, s’explique que l’arbitrage, en dehors des centres d’arbitrage, a connu une période de stagnation jusqu’en 1911, quand ce qui était alors le nouveau Code de Procédure Civile fut établi (Loi I de 1911, Chapitre 17).

Abstract

Arbitration has a tradition of long standing in Hungary. There is evidence that people resorted to arbitration as early as in the XII—XIV centuries, owing to the cumbersomeness of mediaeval jurisdiction. However, arbitration in the sense it is used nowadays starts only in the XIX century. Articles 495–511 of the Act No. LIV of 1868, modified in 1881, were the first to give an extensive ruling on arbitration. The system adopted by the said Act proved to be far from practical, e.g. it required an arbitral body of five members. Thus, arbitration outside the arbitral institutions underwent a period of stagnation until 1911, when the, then, new Code of Civil Procedure was established (Act I of 1911, Chapter 17).
