Résumé
Le premier Code de Commerce de la République, de 1854, réglementait minutieusement la procédure arbitrale. Bien que cette réglementation expresse ait disparu dans les Codes de Commerce de 1884 et 1889 (aujourd’ hui en vigueur), l’arbitrage n’est pas inconnu de ces derniers textes, mais la procédure d’arbitrage se trouve aujourd’hui réglée dans la Code de Procédure Civile ordinaire, laquelle est une partie supplétive du Code de Commerce.
Abstract
The first Commercial Code of the Republic, which dated from 1854, contained precise rules about arbitral procedure, and although no express reference to arbitration appears in the subsequent statutes of 1884 and 1889 (the latter still being in force today), arbitral procedure is not ignored by legislation; it is now incorporated into the general Code of Civil Procedure which supplements the Commercial Code.
