Abstract

Article 19(b) of the Convention for the Protection of Human Rights and Fundamental Freedoms provides that a European Court of Human Rights shall be set up. Article 45 specifies that the jurisdiction of the Court shall extend to all cases concerning the interpretation and application of the Convention which the High Contracting Parties or the Commission shall refer to it.

L’institution d’une Cour européenne des Droits de l’Homme est prévue par l’article 19(b) de la Convention de Sauvegarde des Droits de l’Homme et des Libertés Fondamentales. L’article 45 précise que la compétence de la Cour s’étend à toutes les affaires concernant l’interprétation et l’application de la Convention que les Hautes Parties Contractantes ou la Commission lui soumettront.

The Assembly, likewise, regards it as preferable that any complaint which the Commission considers legitimate, and which it is not able to settle by conciliation, should be referred to a judicial rather than a political organ.
