Abstract
On 31 December 1971, out of sixteen1 Member States of the Council of Europe that had ratified the Convention, eleven had recognised the Commission’s competence to receive individual applications: Austria, Belgium, Denmark, Federal Republic of Germany, Iceland, Ireland, Luxembourg, Netherlands, Norway, Sweden and the United Kingdom.

Following its denuncation of the Convention, Greece ceased to be a Party to the Convention on 13 June 1970.
A la suite de sa dénonciation de la Convention, la Grèce a cessé d’être Partie à la Convention, le 13 juin 1970.
Insofar as the applicant complained that the manner in which the Board carried out an inquiry concerning this purchase violated Art. 5 of the Convention, this complaint was rejected in the partial decision of 24 July 1970, as being manifestly ill-founded. The question whether the Government was responsible under the Convention for any acts of the Board was expressly left open.
Pour autant que le requérant se plaint de ce que la manière dont le “Board” a effectué l’enquête concernant cet achat portait atteinte à l’article 5 de la Convention, ce grief a été rejeté dans la décision partielle du 24 juillet 1970, comme étant manifestement mal fondé. However, in his observations of 17 October 1970, the applicant’s counsel submits that it is obvious from the complaint that the Special Court arrived at its decision on an incorrect basis.

Section 1 (2) of the Act provides: “No appeal shall be under this section except with the leave of the Court below or of the House of Lords; and such leave shall not be granted unless it is certified by the Court below that a point of law of general public importance is involved in the decision and it appears to that Court or to the House of Lords, as the case may be, that the point is one which ought to be considered by that House.”
