Abstract
Following the entry into force on 20 December 1971 of Protocol No. 5 to the European Convention on Human Rights, Articles 22 and 40 of the European Convention concerning the procedure and the election system of the members of the Commission and the Court have been amended.

Par suite de l’entrée en vigueur, le 20 décembre 1971, du Protocole N° 5 à la Convention européenne des Droits de l’Homme, les articles 22 et 40 de la Convention qui concernent la procédure et le système d’élection des membres de la Commission et de la Cour, ont été modifiés en conséquence.

* Greece ratified the Convention and the First Protocol on 28 March 1953. Having denounced the Convention and the First Protocol on 12 December 1969, Greece, in accordance with Article 65 of the Convention, ceased to be a Party to the Convention and the First Protocol on 13 June 1970 — Cf. The declaration made by Austria, Denmark, the Federal Republic of Germany, Iceland, Ireland, Luxembourg, Norway and Sweden pursuant to Articles 25 and 46 of the Convention covers also the rights and liberties mentioned in the Fourth Protocol, Articles 1 to 4; cf. Yearbook, Volume VII, p. 10, p. 14, p. 18; Volume IX, pp. 12–14; Volume X, p. 10; Volume XI, pp. 4–10; Volume XIII, pp. 13–17.
For 5 years and thereafter until notice to the contrary.
For Surinam and Netherlands Antilles only and only in respect of the right to legal assistance in criminal proceedings.
The ratification is valid also for Surinam and for the Netherlands Antilles.
The United Kingdom has extended these declarations to eighteen territories for the international relations of which the United Kingdom is responsible; cf. Yearbook, Volume X, pp. 12–16 and pp. 22–24; Volume XII, pp. 24–28 and pp. 32–36.
This declaration has been extended also to Surinam.
* La Grèce avait ratifié la Convention et le Protocole additionnel le 28 mars 1953. Ayant dénoncé la Convention et le Protocole additionnel le 12 décembre 1969, la Grèce, en vertu de l’article 65 de la Convention, a cessé le 13 juin 1970 d’être Partie à la Convention et au Protocole additionnel — Cf. Annuaire, Vol. XII, pp. 79–85; Vol. XIII, p. 5.
La déclaration faite par l’Autriche, la Belgique, le Danemark, la République Fédérale d’Allemagne, l’Islande, l’Irlande, le Luxembourg, la Norvège et la Suède en vertu des articles 25 et 46 de la Convention comprend aussi les libertés et les droits figurant aux articles 1er à 4 du Protocole N°. 4, cf. Pour cinq ans et par la suite jusqu’à notification du retrait.
Pour Surinam et les Antilles Néerlandaises seulement et uniquement en ce qui concerne le droit à l’assistance en affaires criminelles.
La ratification est également valable pour Surinam et les Antilles Néerlandaises.
Le Royaume-Uni a étendu ces déclarations à dix-huit territoires dont le Royaume-Uni assure les relations internationales; cf. Annuaire, Volume X, pp. 13–17 et pp. 23–25; Vol. XII, pp. 25–29 et pp. 33–37.
Cette déclaration a été étendue aussi à Surinam.
* At the time of signature of the Protocol, the Government of the French Republic declared that it would not apply the provisions of Article 3(b). By letter dated 15th February 1962, the French Minister for Foreign Affairs informed the Secretary General that the reservation was to be replaced by the following declaration: (Translation) “The French Government declares that it will, in application of Article 3(b), grant to Judges during meetings of the Court, the customs and exchange facilities necessary for the free exercise of their functions”.

* Au moment de la signature du Protocole, le Gouvernement de la République Française a déclaré qu’il n’appliquerait pas les dispositions de l’alinéa (b) de l’article 3. Par une lettre en date du 15 février 1962, le Ministre des Affaires Etrangères du Gouvernement français a notifié au Secrétaire Général que la réserve devait être remplacée par la déclaration suivante: “Le Gouvernement français précise qu’en application de l’article 3, alinéa b, il accordera aux juges, pendant les réunions de la Cour, les facilités en matière de douanes et de contrôle des changes qui sont nécessaires pour le libre exercice de leurs fonctions”.
