Abstract
An old common law tradition holds that actions speak louder than words and that it is what is done, rather than what is said, that matters. To some extent this philosophy underlies also the viewpoint of the Office of Legal Adviser, at least in the United States. Insofar as the Office concerns itself with law derived from state conduct, it is the prior action of nations, rather than the characterization and conceptualization of that occasion, to which the legal advisers traditionally tend to lean.
