Abstract

“Good name in man and woman, dear my lord,” wrote Shakespeare, “Is the immediate jewel of their souls; Who steals my purse steals trash; ’tis something, nothing;... But he that filches from me my good name... makes me poor indeed.” The Bhagavad Gita expressed the idea even more emphatically when it said, “For a man of honour defamation is worse than death.” As it is thus considered a great evil, provision for reasonable legislative abridgement of the right of freedom of speech and expression in relation to defamation is made in Article 19(2) of the Indian Constitution.
