Abstract

Once the time period for an annulment action expired, the legality of a Community act becomes generally unassailable — and that even though the act was originally vitiated by some irregularities. An exception of illegality may merely open a limited and belated examination of the validity of a general act or regulation, and that only in so far as it concerns its non-application in a concrete instance.1 A successful charge of illegality merely results in an inapplicability of a general act or regulation, facilitating thus the annulment of an act which was based thereon and which thus lost its legal foundation.
