Abstract
The operation of the European Communities prompts national courts of the Member States to apply provisions of Community law more and more frequently. This is a quite understandable development as Community law covers a wide field, previously occupied by national law, and penetrates deeply into the national legal order. It is, therefore, hardly surprising that national courts are called to apply it much more frequently than they do provisions of international treaties. Applying Community law, national courts have had to rule in a number of instances on its relation with national law in general and with constitutional law in particular.

Preliminary ruling No. 38/75 (Nederlandse Spoorwegen v. Inspecteur der invoerrechten en accijnzen) [1975] ECR 1439, 1450. In this ruling the Court stated: “… since so far as fulfilment of the commitments provided for by GATT is concerned, the Community has replaced the Member States, the mandatory effect, in law, of these commitments must be determined by reference to the relevant provisions in the Community legal system and not to those which gave them their previous force under the national legal systems.” See also Bleckmann, Die Position des Völkerrechts im inneren Rechtsraum der Europäischen Gemeinschaften, 18 Jahrbuch für internationales Recht 300, 313, 318 (1975) and by the same author Der gemischte Vertrag im Europarecht, 11 Europarecht 301, 310 (1976);
