Abstract

Taken together, these two questions constitute the takings issue, an issue that has been raised with respect to the development of land-use regulations in the United States for more than 100 years. It is an issue that continues to attract the attention of legal scholars and economists.

When do regulations amount to a taking of that property such that under the taking clause of the Fifth Amendment we are required to compensate the individuals thus regulated? And when do regulations amount simply to an exercise of the police power, requiring no compensation to those regulated?—Pilon (1988; p.153)
