Abstract

Part III illustrates and applies the principles and theory from Parts I and II. The purpose is to show that the theory provides a basis for analysis and criticism. This involves several elements. The criteria for legally requiring procedural principles are applied to determine whether the law should intervene. Our criteria for determining which decision-making model should apply will be used to determine the appropriate model and thus which principles pertain. The fundamental norm will be used to help analyze particular problems, and appeal will be made to procedures rational persons using these standards and norms would accept for a society in which they expected to live.
