Bis heute wurden Verstöße gegen die Artikel 81 (Kartellverbot) und 82 EG (Verbot der missbräuchlichen Ausnutzung einer marktbeherrschenden Stellung) fast ausschließlich seitens der jeweiligen Wettbewerbsbehörden, wie der EU-Kommission und (seit 2004) den nationalen Wettbewerbsbehörden der Mitgliedstaaten, durchgesetzt.
