Nachdem bisher die Rolle von Verträgen unter einem statischen, der Transaktionskostentheorie folgenden Blickwinkel diskutiert wurde, kommt in diesem Kapitel 3 eine dynamische Perspektive zum Ausdruck, die den Einfluss früherer Erfahrungen auf die Vertragsgestaltung berücksichtigt. Nach einer kurzen Einführung zur Bedeutung von aus Erfahrung resultierenden Lerneffekten für das Management von Unternehmenskooperationen insgesamt (3.1), erfolgt die Schilderung der hierfür zentralen Theorieansätze Evolutionary Economics, Organizational Learning und Knowledge-based View (3.2). Hiernach wird der Stand der empirischen Forschung zur Auswirkung von Erfahrung und Lernen auf das Management von Unternehmenskooperationen im Allgemeinen und auf Verträge im Besonderen dargestellt (3.3). Den Abschluss des Kapitels bildet die Ableitung einer zweiten Gruppe von Hypothesen, die den Einfluss von Erfahrung und Lernen auf die unterschiedlichen Vertragsfunktionen zum Gegenstand haben (3.4).
