Zusammenfassung

Soweit wir zurückblicken können, wird über Begriff und Theorie der verteilenden Gerechtigkeit gestritten (Jodl 1929; Waibl 1982, 1989). Die umfangreichen Kommentare, die sich zu John Rawls Theorie der Gerechtigkeit angesammelt haben, dokumentieren diese offenbar unabschließbare Auseinandersetzung erneut (Daniels 1975; Höffe 1977). Einen Versuch, diesen Dauerstreit zu beenden, hat Friedrich August Hayek vorgelegt, der aus soziologischer Sicht ein besonderes Interesse beanspruchen kann, weil er allen philosophischen Begründungsstrategien aus dem Wege geht,1 um statt dessen eine sozialtheoretische Erklärung von Genese und Funktion von Gerechtigkeitsvorstellungen vorzulegen, die ich, um meinen eigenen Überlegungen zum Problem der sozialen Gerechtigkeit einen Halt zu geben, zunächst rekonstruieren werde. In einem zweiten Schritt versuche ich einige Fragwürdigkeiten der Hayekschen Betrachtungen hervorzukehren, deren Klärung einsichtig werden läßt, unter welchen Voraussetzungen am Begriff der verteilenden oder sozialen Gerechtigkeit, auch gegen Hayeks Bem en, ihn zu diskreditieren, festgehalten werden kann.
