Zusammenfassung

Rituale und Zeremonien durchziehen das Recht. Das muss nicht negativ sein. Rituale bestimmen fast alle sozialen menschlichen, speziell auch rechtlichen Einrichtungen, die die Aufgabe haben, soziale Konflikte zu lösen. Das Ritualkonzept aber wird in der juristischen Analyse kaum verwendet, noch seltener ist es Gegenstand formaler akademischer Studien. Wenn es überhaupt erwähnt wird, so wird das Ritual im Kontext der rechtlichen Verteidigung diskutiert (Fuller 1945, 799–800). Öfters wird es als Fehler im Rechtssystem behandelt.1
