Schutzstandards in der WTO? Die schleichende Verknüpfung der Welthandelsordnung mit standardsetzenden internationalen Institutionen

Zusammenfassung

Angesichts der fortschreitenden Öffnung ehedem nationaler Märkte sinkt die Steuerungsfähigkeit moderner Industriestaaten. Die zunehmende Intensität des Wettbewerbs und die steigende Mobilität wirtschaftlicher Akteure lassen bestimmte Formen staatlichen Handelns unwirksam werden oder erhöhen deren Kosten auf eine nicht mehr tragbare Höhe. Die von internationalen Institutionen ausgehenden Restriktionen reduzieren die staatliche Handlungsfähigkeit weiter. Dies gilt nicht nur für die Finanzierung des Wohlfahrtsstaates (Genschel 2000), sondern auch für die staatliche Fähigkeit, Fragen des Umwelt-, Arbeits- oder Verbraucherschutzes wirksam zu regulieren.

Der Beitrag bildet die erweiterte Fassung der am 18.7.2001 vor der Fakultät Sozial- und Wirtschaftswissenschaften der Otto-Friedrich-Universität Bamberg gehaltenen Antrittsvorlesung des Verfassers.
