Overview
The central marketing of television rights to football matches by an association or league organisation seems quite widely accepted by the public. They are regarded “good monopolists” offering broad TV coverage of football matches and enabling sharing of TV revenue for maintaining a competitive balance among members of a league. This perception contrasts with the intervention of national and European competition authorities against this mode of marketing on the basis of the cartel laws.
While league organisers suggest that there is only room for additional coverage on pay or pay per view TV the fact that live coverage of German 2. Bundesliga matches are regularly the most popular programme on the free TV channel DSF (1.18 million viewers on average) indicate that there is a considerable unsatisfied demand on free TV.
By analysing TV coverage and ratings this papers examines the effects of collective selling on fans, small clubs and TV markets which have so far been widely neglected in the public debate. Furthermore, it tests the arguments given in favour of an exemption under competition law.
