Zusammenfassung
Zum vierten Mal in diesem Jahrhundert wurde die Ungleichheit des Zugangs zum Rechtssystem Gegenstand der öffentlichen und politischen Diskussion in den Niederlanden. Frühere Wellen der Aufmerksamkeit gab es 1903–1914, 1924–1930 und 1949–1957. Wir fanden die erneute Aufmerksamkeit für das Problem der Rechtshilfen auch in anderen westlichen Ländern wie in den USA, Großbritannien und den skandinavischen Ländern. Es gibt Experimente, Forschung und Diskussionen. Das wachsende Interesse für dieses Gebiet kann in Verbindung zur immer problematischer werdenden Position des Individuums im Wohlfahrtsstaat gesehen werden:
-
das wachsende Bedürfnis nach Selbständigkeit (Mündigkeit) für den Bürger gegenüber ‚seinem‘ Staat;
-
die Tendenz, soziale Verhältnisse, die bis jetzt durch Wohlfahrt, Fürsorge, Ermessen oder Behandlung gekennzeichnet waren, in juristische Kategorien zu gießen und diese in Rechten und Pflichten zu spezifizieren;
-
erneute Beachtung nach 1945 für Bürgerrechte, Menschenrechte und konstitutionelle Garantien.
