Abstract
The Swiss legal system is mainly based on statute. Employment matters are principally regulated at the federal level, by the federal Constitution, federal laws and federal ordinances. The Swiss Code of Obligations (Obligationenrecht, OR) and the Labour Law Act (Arbeitsgesetz, ArbG) are the key statutes. Other statutes such as the Swiss Federal Act on Information and Consultation of Workers in Undertakings and the Gender Equality Act govern various employment law issues. Cantonal legislation (Switzerland comprises 26 cantons) covers only limited employment law issues. Case law plays an essential role, however, as it interprets and clarifies statutory provisions.
