Zusammenfassung
Meine Grundthese ist folgende: Der europäische Integrationsprozess kann sich nur dann festigen, wenn er auf einer expliziten politischen Verfassung beruht. Diese politische Verfassung (ein „Political Compact“) sollte den Konflikt zwischen denen lösen, die die europäische Integration als Bürgerprojekt interpretieren, das zu einem supranationalen Staat führen soll, und jenen, die dieses Projekt auf den Mitgliedstaaten gegründet sehen, wobei eine intergouvernementale Organisation angestrebt werden soll. Wir benötigen ein neues Paradigma, das uns zeigt, was die Union von Staaten und Bürgern zusammenhält.

Der Vertrag von Lissabon besteht formal aus drei Verträgen: dem Vertrag von Maastricht über die Europäische Union aus 1992 igF (EUV), dem Vertrag von Rom aus 1957 igF und neubenannt in Vertrag über die Arbeitsweise der Europäischen Union (AEUV), der Grundrechtecharta (die von der Regierungskonferenz, die den Vertrag von Nizza aus 2001 ausgearbeitet hatte, zur Kenntnis genommen, aber nicht formal dem Primärrecht zugeordnet worden ist, was eben mit dem Vertrag von Lissabon geschehen ist).

Diese Sichtweise hat die Haltung des deutschen Bundesverfassungsgerichts durchgehend von der Maastricht-Entscheidung des Jahres 1993 (betreffend die Frage der Verfassungskonformität des Vertrags von Maastricht) bis zu den Entscheidungen aus 2012 betreffend die Verfassungskonformität des Fiskalpakts und des Europäischen Stabilitätsmechanismus geprägt.
