The Committee on the Rights of the Child is severely constrained in terms of the conditions under which it can consider inter-State communications given the stipulations of Article 12 of the OP3-CRC which requires states to make an opt-in declaration recognizing the competence of the Committee to receive and consider inter-State communications:
