Zusammenfassung

Der Begriff „Gewinnbeteiligung“ ist nicht eindeutig. Insbesondere ergab sich eine Verwirrung dadurch, daß man die verschiedensten Arten von Prämien — Lohnsystemen auch in die Gewinnbeteiligung einbezog. Wesentlich für die Gewinnbeteiligung ist jedenfalls, daß ein Teil des Einkommens der Arbeitnehmer in unmittelbarem Zusammenhang mit dem Ertrag des Unternehmens steht und sich entsprechend diesen Einnahmen ändert. Hiebei ist es notwendig, daß von vornherein die Art der Berechnung festgelegt ist. Man könnte z. B. nach allgemeiner Auffassung nicht von Gewinnbeteiligung sprechen, wenn es dem Ermessen des Unternehmers überlassen bliebe, am Ende des Jahres zu entscheiden, wieviel vom Reingewinn als Remuneration oder als Prämie ausgezahlt werden soll. Weiters können wir nur dann von Gewinnbeteiligung sprechen, wenn sie sich auf die Masse der Arbeiterschaft bezieht und nicht etwa ausschließlich auf Angestellte. Gewinnbeteiligung ist ferner kein Ersatz für entsprechende Löhne. Eine der Voraussetzungen für das Funktionieren der Gewinnbeteiligung ist, daß die Löhne des Unternehmens zumindest auf gleicher Höhe stehen wie die anderer Unternehmungen der gleichen Branche. In der Praxis trifft gelegentlich das Gegenteil zu.
