Zusammenfassung

Die Freiheitsstrafe in ihrer modernen Ausprägung beginnt nach allgemeiner Auffassung in der zweiten Hälfte des 16. Jahrhunderts.1 Zu jener Zeit wurden in England und Holland Haftanstalten eingerichtet, in denen der Freiheitsentzug dem Zweck einer planmäßigen Erziehung der Insassen zu Arbeit und Ordnung und damit zu einem gesetzmäßigen Leben dienen sollte. Diese Entwicklung der Freiheitsstrafe hin zu Zielen einer Besserung und sozialen Integration von Straftätern stand im Gegensatz zu den Strafzwecken des römischen, germanischen und fränkischen Strafrechts, wo der Gedanke einer Vergeltung für das begangene Unrecht und einer Unschädlichmachung des Rechtsbrechers dominierte.
