Zusammenfassung

Das Strafvollzugsrecht gehört wie das Kriminalrecht insgesamt zum öffentlichen Recht im weiteren Sinne. Es umfaßt alle Rechtsnormen, welche die Vollziehung freiheitsentziehender Kriminalsanktionen betreffen.1 Schon begrifflich bedeutet Strafvollzug nicht die Durchführung sämtlicher strafgerichtlich verhängten Rechtsfolgen (z.B. auch Geldstrafen). Er beschränkt sich vielmehr auf den stationären Vollzug der die Freiheit eines Straftäters entziehenden Kriminalsanktionen. Zum Bereich des Strafvollzugs zählen damit die Unrechtsreaktionen:

  • Freiheitsstrafe (§§ 38 f. StGB),

  • Jugendstrafe (§§ 17 f. JGG),

  • Unterbringung in einem psychiatrischen Krankenhaus (§ 63 StGB), in einer Entziehungsanstalt (§ 64 StGB) und Sicherungsverwahrung (§ 66 StGB),

  • militärischer Strafarrest (§ 9 WStG).
