Schutz der Demokratie – der Hebel der EU vor und nach Erweiterungen

Zusammenfassung

Die EU versteht sich selbst als Wertegemeinschaft und gleichermaßen als Normexporteurin. Insofern bilden Demokratie, Rechtsstaatlichkeit und der Schutz der Menschenrechte eine essentielle Normentrias, die die EU sich als Fundament für ihr inneres Zusammenleben selbst zuschreibt und daher an hervorgehobener Stelle in den Verträgen verankert hat. Im Vertrag von Lissabon (so wie auch in den Verträgen von Maastricht, Amsterdam und Nizza) findet die Erwähnung jenes Normengerüstes zum einen weit oben in der Präambel Erwähnung. Zum anderen erklärt Artikel 2 des ersten Titels die Werte, auf denen sich die EU gründet, nämlich die Achtung der Menschenwürde, Freiheit, Demokratie, Gleichheit, Rechtsstaatlichkeit und die Wahrung der Menschenrechte sowie Minderheitenrechte.
