Zusammenfassung
„Friede ist keine Selbstverständlichkeit. Ihn zu wahren, zu fördern und zu erneuern, ist eine immerwährend Aufgabe“ – so beginnt die Einleitung der EKD-Friedensdenkschrift von 2007 (EKD 2007, Einleitung). Wie viel Bedeutung bei der Wahrnehmung dieser Aufgabe dem Recht beigemessen wird, zeigt Teil 3 der Friedensdenkschrift, in dem unter dem Titel „Gerechter Friede durch Recht“ sehr eingehend den Anforderungen an eine globale Friedensordnung als Rechtsordnung nachgegangen wird, aber auch dem Paradigma rechtserhaltender Gewalt und den Grenzen rechtserhaltenden militärischen Gewaltgebrauchs. Diese Bedeutungszuschreibung an das (weltliche) Recht ist nur verstehbar vor dem Hintergrund der reformatorischen „Zwei-Regimenten-Lehre“.
