Zusammenfassung
Alberico Gentili und Hugo Grotius stehen am Wendepunkt zwischen der traditionellen Lehre des gerechten Krieges und dem System des modernen Völkerrechts. Während Gentili der Tradition einer kasuistischen Darstellung des Kriegsrechts gemäß dem mos italicus treu bleibt, entwickelt Grotius ein originelles System des Völkerrechts, das den Geist des mos gallicus widerspiegelt. Zugleich erweist sich Gentili in inhaltlicher Hinsicht als Protagonist der Fortbildung des Völkerrechts, während Grotius mit seiner Exposition der Wechselwirkungen zum menschlichen und göttlichen Recht einer christlichen Rechtstheologie verhaftet bleibt.
