Abstract

In order to understand Chinese Labour Law, a retrospective view of the historical development of the law gives useful insight. The missing distinction between law and politics is rooted in Confucianism and has been kept up during the time of imperial reign. Chinese Law (which mainly consisted of criminal law) was not designed to give individuals rights against each other or against the state power (i.e. the imperial bureaucracy).
