Section 3 Provisions Relating to the Award of Contracts Within the Scope of Directive 2009/81/EC (VOB/A—AP) (§§ 1 AP–21 AP)

Abstract

(1) Works contracts are contracts having as their object either the execution, or both the planning and execution of

• 1. a works project or a works for a public contracting authority, where that works project or works

  • a) is the outcome of building or civil engineering work and

  • b) is to fulfil an economic or technical function, or

• 2. work that provides a direct economic benefit to the contracting authority undertaken by a third party according to the requirements specified by the contracting authority.
