Zusammenfassung
Die rechtliche Situation für die Plattformen in Europa entspricht in weiten Teilen der Situation der U.S. Crowdfunding-Plattformen. Auch in den USA sehen sich die Aufsichtsbehörden verpflichtet, besonders die Kleinanleger bei Eigenkapitalinvestments (Crowdinvesting) zu schützen. Öffentliches Einwerben von Kapital war bis vor kurzem für US-Unternehmen nur unter sehr restriktiven Bestimmungen möglich. Dies hat sich jedoch bereits zum Teil geändert bzw. soll sich in den nächsten Monaten noch weiter ändern aufgrund der Bestimmungen des JOBS Acts (Jumpstart Our Business Startups Act).
Die Aufgabenstellung der U.S. Securities and Exchange Commission ist es vor allem, Investoren zu schützen und einen fairen, geordneten und effizienten Markt aufrecht zu erhalten um die Kapitalbildung zu erleichtern. -(U.S. Securities and Exchange Commission (SEC) 2011)
