Zusammenfassung

In dem Beitrag wird der Beitrag der Économie des conventions (EC) zur Analyse des Rechts in der Ökonomie dargestellt. Die EC integriert die institutionentheoretische Analyse des Rechts mit organisations- und wirtschaftssoziologischen Fragestellungen, was sie von den deutschsprachigen Ansätzen abhebt. Das Recht wird aus pragmatischer Perspektive in die Koordinationssituation als Institution „endogenisiert“ und gilt nicht als externer „constraint“. Weiter differenziert die EC die Koordinationslogiken (die Konventionen) von Institutionen, da aus ihrer Sicht Institutionen als unvollständig und interpretativ zu vervollständigen sind. Der Beitrag präsentiert auch neuere Arbeiten zur Rechtsproduktion, zum Staatskonzept der EC sowie zu den organisatorischen Formen des Rechtswesens.
