Zusammenfassung
England besitzt keine umfassende Kodifikation des Handelsrechtes, kein besonderes Handelsgesetzbuch, in welchem das ganze, für den Handel bestimmte Privatrecht niedergeschrieben wäre. Das englische Recht macht keinen Unterschied zwischen dem Recht der handeltreibenden Bevölkerung und dem Recht der Leute, welche den Handel nicht gewerbsmäßig ausüben. Es entspricht in dieser Beziehung der auch in der Schweiz herrschenden Anschauung, daß ein solcher Unterschied nicht angezeigt erscheint. Gleichwohl tragen Gesetze und Rechtsprechung den besonderen Bedürfnissen des Handels hinreichend Rechnung.
