Zusammenfassung

Angesichts der Tatsache, daß ein großer Teil der bei den Gerichten anhängigen Strafsachen Verkehrsdelikte betrifft, ist es nicht verwunderlich, daß die veröffentlichten Urteile in den Fachzeitschriften und in der Tagespresse einen großen Raum einnehmen. Die Öffentlichkeit ist an diesen Urteilen in hohem Maße interessiert; Verkehrsteilnehmer ist praktisch jedermann, und damit kann — anders als bei der sonstigen Kriminalität — nahezu jeder Bürger in die Lage kommen, als Täter oder Opfer an einem Verkehrsunfall beteiligt zu sein. Die Veröffentlichung der Strafurteile in Verkehrssachen birgt allerdings die Gefahr in sich, daß in Laienkreisen Urteile mißverstanden oder, obwohl sie nur auf den abgeurteilten Einzelfall passen, verallgemeinert werden. Das gilt insbesondere für die Rechtsprechung in Fällen der alkoholbedingten Fahruntüchtigkeit. Die Rechtsprechung auf diesem Gebiet ist fast unübersehbar. Es wäre vielleicht besser, wenn die Veröffentlichungen etwas eingeschränkt und nur die wirklich grundlegenden Entscheidungen berücksichtigt würden.
