Abstract
In the Federal Republic of Germany the auxiliary and protective measures in respect of addicts and the mentally ill are provided for by laws passed by the individual states, since the law of public safety, including public health law, falls within their legislative authority. On the other hand, compulsory hospitalization as a result of criminal proceedings is regulated by the penal code and by the code of criminal proceedings, which are federal laws.
