Claim Support in Japan: Legal Aspects

Abstract

When we compare the laws and regulations governing cosmetics in the United States, European Union and Japan, we notice that the pre-manufacturing approval system of the Ministry of Health and Welfare Japan (MHW) has many unique characteristics. Despite repeated efforts made from outside parties in the past to revise this system in line with the changes recently occurring in other countries, no substantial alterations in the stance of the MHW on efficacy claims of cosmetics have taken place since 1980 when the last drastic amendment of the Pharmaceutical Affairs Law (PAL) was carried out [1,2]. We will provide here information about the PAL, especially about those regulations related to efficacy claims for cosmetics (We use the term of efficacy simply here; however, it can also denote clinical effectiveness, usefulness and even product claims).
