Zusammenfassung
Mängel in der Dokumentation können zur Beweislastumkehr und zu Schadenersatzansprüchen führen. Im Zweifel gilt der Grundsatz „Was nicht dokumentiert ist, gilt als nicht getan“. Aus einem Dokumentationsmangel allein kann ein Schadenersatzanspruch nicht abgeleitet werden. Die Pflicht zur Dokumentation ist in Rechtsvorschriften fixiert (z.B.: § 11 Berufsordnung für Ärzte in Bayern. Schlund: Die rechtl. Bedeut. der Dok., Chir.Praxis 40, 415 ff, 1989).
