Abstract
In the EU, judicial cooperation is based on the principle of mutual recognition, which allows direct contacts between the issuing and executing judicial authority. Police cooperation is based on the principle of availability, which allows a fluent exchange of information between law enforcement authorities, as well different modalities of access to EU information systems and databases created previously or in the context of the EU IM Strategy. In both contexts, the rules for the processing and protection of personal data have an increasing importance, especially in light of Art 16 TFEU and 8 EU Charter.
