Zusammenfassung
In dem Beitrag soll erklärt werden, warum in Nach. kriegsstaaten, die, wie Kambodscha oder das Kosovo, temporär unter UN-Verwaltung standen, das Völkerstrafrecht keine nennenswerte Rolle im Transitionsprozess gespielt hat, obwohl gerade die Vereinten Nationen ein wichtiger Normunternehmer bei der Durchsetzung völkerstrafrechtlicher Normen waren und sind. Mit einem Verständnis von Völkerstrafrechtspolitik, das das Spannungsverhältnis von Recht und Politik in den Mittelpunkt der Analyse von Transitional Justice als einem globalen Modell der Aufarbeitung von Menschenrechtsverletzungen rückt, wird argumentiert, dass internationale Administrationen den Übergangsprozess in erster Linie als einen politischen Prozess verstehen, in dem der Einsatz rechtlicher Mittel stets unter der Maßgabe bewertet wird, welche - positiven oder negativen - Folgen dieser Einsatz für den Friedensprozess hat. Der Fall Kambodschas, der hier zur Illustration verwendet wird, zeigt, dass die Vereinten Nationen sich erst dann, wenn sie keine faktische Regierungsverantwortung mehr innehaben, für Transitional Justice einsetzen und dem internationalen Strafrecht zur Durchsetzung verhelfen wollen.
